TurboTax On-Time E-File Guarantee

TurboTax guarantees on-time tax return delivery by April 15, 2008, if you eFiled using TurboTax by midnight local U.S. time, April 15, 2008.

If a TurboTax electronic filing system failure prevents Intuit from timely delivering an electronically filed federal or state tax return to the appropriate tax agency by April 15, 2008, then Intuit will reimburse affected TurboTax customers any late filing penalties and interest levied by and paid to the tax agency attributable to Intuit’s filing delay.
To be eligible for this guarantee, you must: (a) have updated TurboTax with the most recent software update available prior to filing your return, (b) have followed any TurboTax instructions concerning filing your return and checking electronic filings status after transmission to Intuit, (c) have taken prompt action to file or re-file your tax return as soon as reasonably possible (but not more than 7 days) after you become aware of the filing error, (d) have notified Intuit in writing within 30 days of the date shown on any late filing assessment by the applicable tax agency, and (e) promptly submit any relevant documentation requested by Intuit. Any reimbursement does not include any fees paid to Intuit.

Intuit is not liable for any failure to timely transmit any federal or state tax return (i) due to reasons beyond Intuit’s commercially reasonable control, including but not limited to internet outages or “acts of God”; or (ii) to the extent that customer contributed to any failure, for example, because of deficiencies in the customer’s tax return that prevented timely filing or acceptance (e.g., name and SSN mismatch, or payment failure) or a failure to follow TurboTax instructions.

Intuit will then contact you promptly to resolve the issue. To resolve your matter, Intuit may require supporting information such as a copy of any IRS/state notice, or evidence of payment of the specified penalty and interest.
